TERMS AND CONDITIONS OF THE ONLINE STORE

1. GENERAL PROVISIONS


1. The online store: Polish Heritage Estates - Monika Nawrocka, operating at: www.polishheritageestates.pl, is run by: Monika Nawrocka, based at: Łabiszynek 20/9 62-200 Gniezno.

2. These Terms and Conditions of the online store define the rules for making purchases in the online store: Polish Heritage Estates - Monika Nawrocka, particularly the rules and procedures for concluding distance sales contracts through the Store, as well as the procedure for handling complaints and the procedure for withdrawal from the contract by the Consumer.

3. In terms of Services provided electronically, these Terms and Conditions are the regulations referred to in Article 9 of the Act on Providing Services by Electronic Means of July 18, 2002 (i.e.Journal of Laws of 2020, item 344, as amended).

4. The Terms and Conditions are directed to all Customers of the Store. All Customers are obliged to familiarize themselves with the provisions of the Terms and Conditions before making a purchase.

5. Each Customer is obliged to comply with the provisions of the Terms and Conditions. Sales are conducted based on the version of the Terms and Conditions in effect at the time of placing the order.

6. Each Customer has the opportunity to review the Terms and Conditions at any time by clicking on the Store's website: www.polishheritageestates.pl on the hyperlink: "Store Regulations". The Terms and Conditions can be downloaded and printed at any time.

7. All information contained on the Store's website: www.polishheritageestates.pl, relating to products (including prices), do not constitute an offer within the meaning of Article 66 of the Act of April 23, 1964, the Civil Code (i.e. Journal of Laws of 2023, item 1610, as amended), but an invitation to conclude a contract, pursuant to Article 71 of the Act of April 23, 1964, the Civil Code (i.e. Journal of Laws of 2023, item 1610, as amended). By sending the Order Form, the Customer submits an offer to purchase and deliver the specified Goods or the specified Service at the price and under the conditions specified in the description.


2. DEFINITIONS


Terms and Conditions - this collection of regulations organizing the principles of using the Store's Services by Customers.

Consumer - a natural person concluding a Contract via the Store, not directly related to their business or professional activity.

Entrepreneur with Consumer Rights - a natural person concluding a civil law contract via the Store, directly related to their business activity, when it is evident from the content of this Contract that it does not have a professional character for this person, particularly based on the subject of their business activity, made available under the provisions on the Central Register and Information on Economic Activity. For the purposes of these Terms and Conditions, it is assumed that in the absence of distinction between the two indicated groups of entities, the Terms and Conditions apply to both Consumers and Entrepreneurs with Consumer Rights.

Customer - a natural person (including the Consumer) who is at least 13 years old (provided that they have obtained consent from their legal representative), a legal entity, and an organizational unit that is not a legal entity, which specific provisions grant legal capacity, who uses the Services provided by the Store.

Order Form - a Service available on the Store's website, through which the Customer can make a purchase, particularly by adding Goods, Services, or digital services to the Cart and specifying certain conditions of the Sales Agreement, including the method of delivery and payment.

Cart - an element of the Store, in which the Goods or Services selected by the Customer are visible and in which the Customer can determine and modify the details of the Order, including the quantity of purchased Products.

Store - an online service owned by the Seller, available at the domain: www.polishheritageestates.pl, through which the Customer can purchase Goods or Services from the Seller.

Seller - Monika Nawrocka, based at: Łabiszynek 20/9 62-200 Gniezno, who, conducting a business or professional activity, offers sales through her website.

Goods - movable items that are the subject of trade between the Store and the Customer, the terms of sale of which are defined by the Order Form.

Goods with Digital Elements - goods containing digital content or a digital service or connected to them in such a way that the absence of digital content or a digital service would prevent their proper functioning.

Service - economic activity of a non-productive nature, provided without the simultaneous presence of the Seller and the Client (remotely), through data transmission at the individual request of the Client, sent and received using electronic processing devices, including digital compression, and data storage, which is entirely transmitted, received, or conveyed via a telecommunications network as defined in the Act of July 16, 2004 - Telecommunications Law (i.e. Journal of Laws of 2021, item 576, as amended.).

Digital service - a service that allows the Consumer to create, process, store, or access data in digital form; shared use of data in digital form that has been transmitted or created by the Consumer or other users of this service or other forms of interaction using data in digital form, e.g., video and audio content exchange services, online file storage services, text editing, or cloud-based games, cloud data storage services, email, social media, and applications operating based on the cloud.

Product - any goods or services, including real estate, digital services, and digital content, as well as rights and obligations.

Digital environment - computer hardware, software, and network connections used by the Consumer to access digital content or digital services or to use them.

Integration - the connection of digital content or digital services with elements of the Consumer's digital environment and their incorporation into these elements to ensure compliance with the Agreement for the provision of digital content or digital services.

Compatibility - the interaction of digital content, digital services, or goods with computer hardware or software that is typically used to access digital content, digital services, or goods of the same kind, without the need for transformation.

Functionality - the ability of digital content, digital services, or goods to perform their functions considering their intended purpose.

Interoperability - the ability of digital content, digital services, or goods to interact with computer hardware or software other than those typically used to access digital content, digital services, or goods of the same kind.

Online trading platform - a service utilizing software, including a website, part of a website, or an application, operated by the entrepreneur or on their behalf, through which Consumers can enter into distance contracts with other entrepreneurs or individuals who are not entrepreneurs to enter into distance contracts with other individuals who are not entrepreneurs.

Provider of the online trading platform - an entrepreneur that operates the online trading platform, provides entities with the online trading platform, or enables the use of this platform.

Agreement - a distance sales agreement for Goods, Services, or digital services concluded by the Client through the Store, usually through the Order Form.


3. ACCEPTANCE AND FULFILLMENT OF ORDERS


1. The condition for using the Store is familiarization with and acceptance of these Regulations. By placing an order, the Client accepts the content of the Regulations.

2. The main parameters determining the ranking of offers presented to the Consumer as a result of searching, also presented in direct connection with a given offer, in a visible manner, are as follows:

To organize search results, the Store uses various criteria, including purchase history, product popularity, current promotions, and availability in stock.

3. The Store indicates sponsored offers and paid advertisements. This information is presented in direct connection with a given search result, in a visible manner that stands out from the general interface.

4. The price stated in the order constitutes the total amount that the Client is obliged to pay, including the applicable tax (gross price). The cost of delivery is not included in the price, as it depends on the delivery method chosen by the Client for the Product.

5. If the Consumer is required to pay an amount exceeding the agreed price described in the previous paragraph, the Store will promptly inform the Consumer of this fact, explaining the reason for the price difference. The Consumer will only be charged additional costs after obtaining their explicit consent.

6. The Seller reserves the right to change the prices in the Store, introduce new Products for sale, conduct and cancel promotional actions, or make changes to them, in accordance with applicable law.

7. In case of a promotion, the Store informs Customers of the lowest price of the Product from the last 30 days. If the Product has been on sale for less than 30 days, the price before the promotion is the lowest price since the Product was introduced to the Store. This information is presented next to the promotional price of the Product.

8. Orders from Customers are accepted via the sent Order Form, made through the website: www.polskierodoweposiadlosci.pl or via email at: polskierodoweposiadlosci@gmail.com, 7 days a week, 24 hours a day.

9. To place an order for a Product, the Customer selects the Goods, Services, or digital service they are interested in, clicks the "ADD TO CART" button located next to the Product description, and then, from the "CART" section in the Store tab, fills out the Order Form, including selecting the delivery and payment method or choosing the cash on delivery option if available for the selected Product, and then clicks to confirm the purchase.

10. Entrepreneurs acting as Consumers should indicate at the time of placing the order for Products that the purchase is not of a professional nature.

11. After placing an order, the Customer receives confirmation of the order placed at their email address provided in the Order Form.

12. Upon receiving confirmation of the acceptance of the offer by the Customer, the order fulfillment process by the Seller begins, with the following:

a) in the case of an order paid on delivery - it begins at the latest the next business day after confirmation by the Seller.

b) in the case of an order paid by traditional bank transfer - it begins after the payment for the placed order is credited to the Store's bank account.

13. Orders placed in the Store are processed during Store working hours (on business days, from Monday to Friday, from 8:00 to 16:00). Orders placed on business days after 16:00, on Saturdays, Sundays, or holidays, will be processed the next business day.

14. The Customer will receive a message confirming the acceptance of the order for fulfillment, which is understood as the Seller's statement of acceptance of the offer. Upon receipt by the Customer, a Sales Agreement is concluded.

15. A VAT receipt is issued for each order. At the Customer's request, a VAT invoice will also be issued and sent to the Customer (Article 106b paragraph 3 of the Act of March 11, 2004 on Goods and Services Tax,i.e., Journal of Laws of 2023, item 1570, as amended..).

16. The available means of communication between the Customer and the Store are:

d) Address for the purpose of exercising the right of withdrawal from the Agreement: Łabiszynek 20/9, 62-200 Gniezno

17. The Seller verifies the authenticity of reviews provided by Customers who purchased Products in the Store in the following way:

The Store provides buyers with a link where they can leave a review; verification is done via email.

18. The Seller does not post false or distorted reviews. Published reviews are both positive and negative.


4. DELIVERY AND TRANSPORT COSTS


1. The shipment of the order in the Store is carried out through:

2. The shipping fee (in PLN) via Polish Post is:

- 19 PLN gross (package up to 2 kg);

- 22 PLN gross (package up to 5 kg).

3. Orders placed in the Store are processed only on business days. Orders placed on Saturdays, Sundays, and holidays will be processed on the next business day.

4. The expected delivery time is usually: 5 business days. The waiting time consists of the order processing time, i.e., assembling the Products for the order, and the estimated delivery time, which is from 24 hours for Poland.

5. The Seller is not responsible for delays caused by the carrier.

6. Upon receiving the package delivered by the courier, the Customer should carefully check the contents and completeness of the package, the condition of the outer packaging, and the condition of the ordered Product in the presence of the courier. In case of damage to the package, the Customer should prepare a damage report with the courier, in two identical copies signed by the Customer and the courier.

7. There is an option for personal collection of the ordered Product at the stationary Store, located at: Łabiszynek 20/9, 62-200 Gniezno.


5. PAYMENT PROCESSING


1. The following payment methods are available within the Store:

1) cash on delivery – upon receipt of the package;

2) bank transfer to account – 77 1020 4115 0000 9202 0229 3223;

3) Online payment via the payment platform Przelewy 24;

4) Payment in cash at the time of personal collection of the goods.

2. Detailed rules and conditions for making payments via banks or other available services are defined by the relevant regulations of the respective banks and services.

3. The customer who has chosen the bank transfer payment option is obliged to pay for the placed order within five (5) working days from the date of placing the order. Otherwise, the Seller's offer is not binding, and the order is removed from the system. In the payment title, it is sufficient to provide only the order number.


6. COMPLAINT



1. The Seller is liable for the non-conformity of the Product with the Agreement. The provisions of the Act of April 23, 1964, the Civil Code, do not apply to contracts obliging to transfer ownership of Goods to the Consumer, including in particular sales contracts, delivery contracts, and contracts for work that are Goods.(i.e., Journal of Laws of 2023, item 1610, as amended.), concerning warranty for defects.

2. The Seller is liable for the non-conformity with the Agreement of the Product that exists at the time of its delivery and is revealed within two (2) years from that moment unless the shelf life of the Product for use, specified by the Seller, its legal predecessors, or persons acting on their behalf, is longer. It is presumed that the lack of conformity of the Product with the Agreement that was revealed before the expiration of two (2) years from the moment of delivery existed at the time of its delivery unless proven otherwise or this presumption cannot be reconciled with the specificity of the Product or the nature of the lack of conformity of the Product with the Agreement.

3. If the Product is non-conforming with the Agreement, the Consumer may demand its repair or replacement. The Seller may replace the Product when the Consumer demands repair, or the Seller may repair the Product when the Consumer demands replacement, if bringing the Product into conformity with the Agreement in the manner chosen by the Consumer is impossible or would require excessive costs for the Seller. If repair and replacement are impossible or would require excessive costs for the Seller, they may refuse to bring the Product into conformity with the Agreement.

4. The Seller performs the repair or replacement within a reasonable time from the moment the Consumer informs them of the non-conformity with the Agreement, and without excessive inconvenience to the Consumer, taking into account the specificity of the Product and the purpose for which the Consumer purchased it. The costs of repair or replacement, including in particular the costs of postage, transport, labor, and materials, are borne by the Seller. For this purpose, the Consumer will provide the Seller with the Product subject to repair or replacement. The Seller collects the Product from the Consumer at their own expense. If the Product was installed before the non-conformity with the Agreement was revealed, the Seller disassembles the Product and reassembles it after the repair or replacement or commissions these activities at their own expense.

5. If the Product is non-conforming with the Agreement, the Consumer may submit a declaration to reduce the price or withdraw from the Agreement when:

a) The Seller refused to bring the Product into conformity with the Agreement;

b) The Seller did not bring the Product into conformity with the Agreement;

c) The lack of conformity of the Product with the Agreement still exists, despite the Seller's attempts to bring the Product into conformity with the Agreement;

d) The lack of conformity of the Product with the Agreement is significant enough to justify a price reduction or withdrawal from the Agreement without prior request for its repair or replacement;

e) From the Seller's declaration or circumstances, it is clear that they will not bring the Product into conformity with the Agreement within a reasonable time or without excessive inconvenience to the Consumer.

6. The reduced price must remain in proportion to the price resulting from the Agreement, in which the value of the non-conforming Product remains to the value of the conforming product. The Seller refunds the amounts due to the Consumer as a result of exercising the right to reduce the price immediately, no later than fourteen (14) days from the day of receiving the Consumer's declaration of price reduction.

7. The Consumer may not withdraw from the Agreement if the lack of conformity of the Product with the Agreement is insignificant. It is presumed that the lack of conformity of the Product with the Agreement is significant.

8. In the event of withdrawal from the Agreement, the Consumer immediately returns the Product to the Seller at their expense. The Seller refunds the price to the Consumer immediately, no later than fourteen (14) days from the day of receiving the Product or proof of its return, using the same payment method used by the Consumer, unless the Consumer explicitly agreed to another method of return that does not incur any costs for them.

9. Complaints regarding Products may be submitted:

a) in writing, to the address of the Seller's registered office: Łabiszynek 20/9 62-200 Gniezno;

b) by email, to the address: polskierodoweposiadlosci@gmail.com.

10. The complaint should include:

a) the details of the person filing the complaint (name and surname, correspondence address, email address, and contact phone number);

b) indication of the reason for the complaint and the content of the request;

c) the Order number, as stated in the Order confirmation;

d) the original or a copy of the proof of purchase (e.g. receipt or invoice) may facilitate the filing of the complaint, but is not necessary for its submission.

11. The above provisions do not exclude the possibility of the Seller providing a warranty for the purchased Products, as provided in a separate warranty regulation.


7. RIGHT OF WITHDRAWAL


1. According to the Act of May 30, 2014 on consumer rights (i.e.Journal of Laws of 2020, item 287, as amended), the Consumer may withdraw from the Agreement concerning Products purchased in the Store without giving a reason, by submitting a relevant statement in writing within fourteen (14) days from the date of delivery of the Goods (i.e. from the date of receipt of the Goods by the Consumer) or receipt of the Service, content, or digital service. This period is considered maintained if the Consumer sends the statement before its expiration.

2. The Consumer may withdraw from the Agreement by submitting a statement of withdrawal from the Agreement to the Seller. The template of the statement is attached as Appendix No. 1 to these Terms.

3. The statement of withdrawal from the Agreement should be sent to the address: Łabiszynek 20/9 62-200 Gniezno.

4. The Consumer shall return the Goods to the Seller within fourteen (14) days from the day on which they withdrew from the Agreement. To meet the deadline, it is sufficient to return the Goods before its expiration.

5. The Consumer bears only the direct costs of returning the Goods.

6. The return of the Goods should be made to the Seller's address: Łabiszynek 20/9 62-200 Gniezno.

7. The Seller, within fourteen (14) days from the date of receiving the statement of withdrawal from the Agreement, will refund all payments made by the Consumer, including the cost of delivering the Goods, provided that the refund of payment will not occur until the Goods are returned or the Consumer provides proof of its return.

8. If the Consumer has chosen a method of delivery of the Goods other than the cheapest method of delivery offered by the Seller, the Seller is not obliged to reimburse the Consumer for the additional costs incurred.

9. The Seller will refund the payment using the same payment method that the Consumer used.

10. The Consumer is liable for any reduction in the value of the Product resulting from use that exceeds what is necessary to ascertain the nature, characteristics, and functioning of the Product.

11. The right to withdraw from the Sales Agreement does not apply to the Consumer in relation to the Agreement:

a) where the subject of the service is a non-prefabricated Goods produced according to the Consumer's specifications or serving to satisfy their individualized needs;

b) where the subject of the service is Goods that spoil quickly or have a short shelf life;

c) where the subject of the service is alcoholic beverages, the price of which was agreed upon at the conclusion of the Agreement, and whose delivery may only occur after 30 days and whose value depends on fluctuations in the market beyond the Seller's control;

d) where the subject of the service is Goods delivered in sealed packaging that cannot be returned after opening for health protection or hygiene reasons, if the packaging was opened after delivery;

e) where the subject of the service is Goods that, due to their nature, are inseparably mixed with other goods after delivery;

f) where the subject of the service is audio or visual recordings or computer programs delivered in sealed packaging, if the packaging was opened after delivery;

g) for the delivery of newspapers, periodicals, or magazines, except for subscription agreements;

h) where the price or remuneration depends on fluctuations in the financial market beyond the Seller's control, which may occur before the expiration of the withdrawal period;

i) for the delivery of Goods with digital elements, digital services, or digital content not delivered on a tangible medium, for which the Consumer is obliged to pay a price, if the Seller has commenced performance with the express and prior consent of the Consumer, who has been informed before the commencement of performance that after the Seller's performance they will lose the right to withdraw from the Agreement, and has acknowledged this, and the Seller has provided them with confirmation;

j) concluded through a public auction.

k) for the provision of accommodation services, other than for residential purposes, transportation of goods, car rentals, catering, services related to recreation, entertainment, sports, or cultural events, if the Agreement specifies the day or period of service provision;

l) in which the Consumer has expressly requested the Seller to come to them for urgent repair or maintenance; if the Seller additionally provides other services than those requested by the Consumer, or delivers goods other than spare parts necessary for the repair or maintenance - the right to withdraw from the Agreement applies to the Consumer in relation to the additional Services or Goods;

m) for the provision of services for which the Consumer is obliged to pay a price, in the case where the Consumer has expressly requested the Seller to come to them for repair, and the service has already been fully performed with the Consumer's explicit and prior consent.

12. The right to withdraw from a distance Agreement is granted to Consumers and Entrepreneurs under Consumer rights.


8. ALTERNATIVE DISPUTE RESOLUTION


1. If the complaint procedure does not yield the expected result for the Consumer, the Consumer may use, among others,:

  • Mediation conducted by the relevant regional Provincial Inspectorate of Trade Inspection, to which a request for mediation should be submitted. As a rule, the procedure is free of charge. A list of Inspectorates can be found at: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
  • Assistance from the relevant regional permanent consumer arbitration court operating at the Provincial Inspectorate of Trade Inspection, where a request for the case to be considered by the arbitration court should be submitted.   • Free assistance from the municipal or district consumer ombudsman.
  • Internet ODR platform, available at: http://ec.europa.eu/consumers/odr/.

2. This chapter titled "Alternative Dispute Resolution" does not apply to Entrepreneurs under Consumer rights.


9. PERSONAL DATA PROTECTION


1. By placing orders, the Client consents to the processing of their personal data provided by them for the purpose of order fulfillment and servicing by the Seller, who is also the administrator of personal data, within the meaning of Article 7 of the Regulation of the European Parliament and Council (EU) 2016/679 of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), Official Journal of the EU L 119, May 4, 2016, pp. 1–88.

2. The administrator of the personal data provided by the Client while using the Store is the Seller.

3. Personal data contained in the Seller's database is not transferred to entities that do not participate in the performance of the Agreement.

4. According to Article 15 of the Regulation of the European Parliament and Council (EU) 2016/679 of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), Official Journal of the EU L 119, May 4, 2016, pp. 1–88, the Client has the right to access their personal data, may request its correction or deletion. The Seller ensures every Client the right to control their processed personal data.

5. Providing personal data is voluntary; however, lack of consent for processing personal data prevents the fulfillment of the Client's order.

6. Detailed information regarding personal data and privacy protection is included in the "Privacy Policy" section on the Store's website.


10. FINAL PROVISIONS



1. The Regulations define the principles of concluding and executing the Sale Agreement for Products available on the Store's website.

2. The Sale Agreement is concluded between the Client and the Seller.

3. The Regulations are available to all Clients in electronic form on the Store's website: www.polskierodoweposiadlosci.pl, in the section: "Store Regulations."

4. To use the Store's Services, it is necessary to have devices that allow access to the internet and a web browser that enables displaying web pages, as well as providing an email address for sending information regarding the order fulfillment.

5. It is prohibited for all persons, including Clients, to post unlawful content on the Store's website.

6. In matters not regulated by these Regulations, appropriate provisions of generally applicable law shall apply.

7. The Regulations do not exclude or limit any rights of the Client, who is a Consumer, that are granted to them under absolutely binding provisions of law. In the event of a conflict between the provisions of the Regulations and the absolutely binding provisions of law that grant rights to consumers, the provisions of law take precedence.

8. Provisions of the Regulations that are less favorable for the Consumer than the provisions of the Act of May 30, 2014 on consumer rights (i.e., Journal of Laws of 2020, item 287, as amended.) are invalid, and the provisions of the Act shall apply in their place.

9. If any provision of these Regulations is or becomes invalid or ineffective, the validity of the entire Regulations in the remaining part remains unaffected. In such a case, the Parties shall replace the invalid or ineffective provision with another that as closely as possible reflects the intended economic purpose. This also applies to any gaps in the Regulations.

Hereby, acting on the basis of Article 27 of the Act of May 30, 2014 on consumer rights (i.e., Journal of Laws of 2020, item 287, as amended.), in the wording:



Article 27 of the Act on Consumer Rights

A Consumer who has concluded a distance contract or a contract outside the business premises may withdraw from it within 14 days without giving any reason and without incurring costs, except for the costs specified in Articles 33, 34(2), and 35.

Instruction:



The Consumer, as well as the Entrepreneur on consumer rights, has the right to withdraw from the Agreement within 14 days, without giving any reason, and in the case of an Agreement concluded during an unannounced visit to the Consumer's place of residence or usual stay, or during a trip - within 30 days. The deadline for withdrawing from the Agreement expires after 14 days from the date of concluding the Agreement or when the Consumer took possession of the goods/batch of goods or parts, or when a third party, other than the carrier and indicated by the Consumer, took possession of the goods/batch or parts, and in the case of an Agreement concluded during an unannounced visit to the Consumer's place of residence or usual stay, or during a trip - after 30 days from the date of taking possession of that goods/batch of goods.

To exercise the right to withdraw from the Agreement, the Consumer must inform the Seller, i.e., Polish Family Estates - Monika Nawrocka, at the address: Łabiszynek 20/9 62-200 Gniezno, via e-mail: polskierodoweposiadlosci@gmail.com, of their decision to withdraw from the Agreement by means of an unambiguous statement sent by traditional mail or electronically. The Consumer may use the template withdrawal form attached to these Regulations, which is not mandatory. The deadline is considered met if the Consumer sent the information regarding the exercise of the right to withdraw from the Agreement before the expiry of the withdrawal period. The Consumer should return or deliver the Product to the Seller at the address: Łabiszynek 20/9 62-200 Gniezno, without delay, and in any case no later than 14 days from the day on which they informed the Seller of the withdrawal from the Agreement. This deadline is considered met if the Consumer returned the Product to the Seller before the expiry of the 14-day period.

In the event of withdrawal from the Agreement, the Seller shall refund the Consumer all payments received from the Consumer, including the costs of delivering the Product (except for additional costs resulting from the delivery method chosen by the Consumer, other than the cheapest and standard delivery method offered by the Seller), without delay, and in any case no later than 14 days from the day on which the Seller was informed of the intention to exercise the right of withdrawal from the Agreement. The Seller may withhold the refund until the Product is received or until the Consumer provides proof of its return, depending on which event occurs first. The Seller will refund the payment using the same payment method used by the Consumer in the original transaction, unless the Consumer has expressly agreed to a different solution - in any case, the Consumer shall not incur any fees in connection with this refund.
